Terms of use — Hey Blop

Questo documento è solo in inglese.

Il resto del sito è nella tua lingua; queste due pagine non ancora. Sono bozze scritte su ciò che l'app fa davvero, e un documento legale tradotto senza una revisione dice qualcosa che nessuno ha verificato. Chiedici pure qualsiasi cosa a contact@heyblop.com.

These terms are the agreement between you and Juliette Grieneisen about using Hey Blop. They are deliberately short, and they try to say what is actually true rather than everything that could conceivably be said.

What Hey Blop is

An app for keeping track of how you sleep, and for waking you up. You tell it when you go to bed and when you wake; it shows you what that adds up to over time, and it rings in the morning. If you switch listening on, it also measures how loud your room is through the night, so it can ring at a moment you are already stirring rather than out of your deepest sleep. The privacy policy says exactly what that keeps and what it does not.

What it is not

Hey Blop is not a medical device and gives no medical advice. It does not diagnose, treat, or screen for anything, sleep disorders included. What it shows you is a record of what you told it and what it measured, not a clinical finding. If you are worried about your sleep or your health, talk to a doctor — please do not use this app instead.

An alarm can fail. It depends on your phone: its battery, its settings, the permissions you granted, whether the operating system decided to close the app overnight, and whether the manufacturer's own power saving interfered. The app does a great deal to survive all of that, and it still cannot promise to. If missing a morning would be serious, set a second alarm on something else.

Your account

You need one, and you must be at least 16 years old. Keep your password to yourself. Everything you put in is yours; what happens to it is in the privacy policy, which is part of these terms.

You can delete your account from inside the app at any moment. It takes your nights with it and cannot be undone.

We may close an account that is being used to attack the service or to break the law. That is not a licence to close accounts we merely dislike.

Paying

The first ten days are free, and they need no card. You are not asked for payment details to begin them, nothing is charged when they run out, and there is nothing to cancel. They are ours to give, not a store free trial, so nothing is quietly renewing in the background while they run. At the end of them, you decide — and if you decide not to, nothing happens.

After that, Hey Blop is a paid subscription. The alarm, the pond and your profile never lock, because somebody who has come to rely on this app to get up must still get up, and deleting your account is never something to pay for. What waits behind the subscription is everything about looking back: the path, the statistics, and the detail of a night.

The purchase is made through Apple's App Store or Google Play, not from us — they take the payment, they handle the tax, and your contract for the purchase itself is with them.

Which means, plainly:

subscription for you and we cannot see your payment details.

help you ask them.

and the renewal are shown before you buy, in the app.

content, are unaffected by anything written here.

Nothing you recorded is ever deleted for not paying. If a subscription ends, or the ten days run out and you decide against it, the path and the statistics go behind the notice — but every night you recorded is still there, untouched, and all of it comes back the moment you subscribe. Your alarm goes on ringing throughout. The only thing you lose is the looking back, and you lose it temporarily.

What we promise, and what we do not

We try to keep the app working and your data safe, and we will say so plainly when we fail. But the app is provided as it is: there is no guarantee that it will be available without interruption, that every number will be right, or that it will suit any particular purpose you have in mind for it.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss — including, and this is the one that matters here, anything that follows from an alarm that did not go off.

Changes

These terms may change — because the app changes. If a change matters to you, we will tell you in the app rather than hoping you re-read this page. Continuing to use Hey Blop after that means you accept the new version.

Law

These terms are governed by the law of Switzerland, and any dispute belongs to its courts. If you are a consumer, this does not take away the protection of the mandatory law of the country you live in.
